Exclusive: As Saudis bombed Yemen, U.S. worried about legal blowback

The Obama administration went ahead with a $1.3 billion arms sale to Saudi Arabia last year despite warnings from some officials that the United States could be implicated in war crimes for supporting a Saudi-led air campaign in Yemen that has killed thousands of civilians, according to government documents and the accounts of current and former officials.

State Department officials also were privately skeptical of the Saudi military's ability to target Houthi militants without killing civilians and destroying "critical infrastructure" needed for Yemen to recover, according to the emails and other records obtained by Reuters and interviews with nearly a dozen officials with knowledge of those discussions.

U.S. government lawyers ultimately did not reach a conclusion on whether U.S. support for the campaign would make the United States a "co-belligerent" in the war under international law, four current and former officials said. That finding would have obligated Washington to investigate allegations of war crimes in Yemen and would have raised a legal risk that U.S. military personnel could be subject to prosecution, at least in theory.

The previously undisclosed material sheds light on the closed-door debate that shaped U.S. President Barack Obama’s response to what officials described as an agonizing foreign policy dilemma: how to allay Saudi concerns over a nuclear deal with Iran - Riyadh's arch-rival - without exacerbating a conflict in Yemen that has killed thousands.

The documents, obtained by Reuters under the Freedom of Information Act, date from mid-May 2015 to February 2016, a period during which State Department officials reviewed and approved the sale of precision munitions to Saudi Arabia to replenish bombs dropped in Yemen. The documents were heavily redacted to withhold classified information and some details of meetings and discussion.

An air strike on a wake in Yemen on Saturday that killed more than 140 people renewed focus on the heavy civilian toll of the conflict. The Saudi-led coalition denied responsibility, but the attack drew the strongest rebuke yet from Washington, which said it would review its support for the campaign to "better align with U.S. principles, values and interests."

The State Department documents reveal new details of how the United States pressed the Saudis to limit civilian damage and provided detailed lists of sites to avoid bombing, even as officials worried about whether the Saudi military had the capacity to do so.

State Department lawyers "had their hair on fire" as reports of civilian casualties in Yemen multiplied in 2015, and prominent human rights groups charged that Washington could be complicit in war crimes, one U.S. official said. That official and the others requested anonymity.

During an October 2015 meeting with private human rights groups, a State Department specialist on protecting civilians in conflict acknowledged Saudi strikes were going awry.

"The strikes are not intentionally indiscriminate but rather result from a lack of Saudi experience with dropping munitions and firing missiles," the specialist said, according to a Department account of the meeting.

"The lack of Saudi experience is compounded by the asymmetric situation on the ground where enemy militants are not wearing uniforms and are mixed with civilian populations," he said. "Weak intelligence likely further compounds the problem."

The Saudi government has called allegations of civilian casualties fabricated or exaggerated and has resisted calls for an independent investigation. The Saudi-led coalition has said it takes its responsibilities under international humanitarian law seriously, and is committed to the protection of civilians in Yemen. The Saudi embassy in Washington declined further comment.

In a statement issued to Reuters before Saturday's attack, National Security Council spokesman Ned Price said, "U.S. security cooperation with Saudi Arabia is not a blank check. ... We have repeatedly expressed our deep concern about airstrikes that allegedly killed and injured civilians and also the heavy humanitarian toll paid by the Yemeni people."

The United States continues to urge the Kingdom to take additional steps to avoid "future civilian harm," he added.

The White House convened a meeting in August 2015 on how best to engage the Saudis over rising civilian casualties, the emails show, in a sign of mounting concern over the issue. That same month, State Department officials gathered to discuss how to track those casualties.

In late January 2016, Deputy Secretary of State Antony Blinken chaired a meeting with officials across the department in part to discuss "Options to limit U.S. exposure to LOAC (Law of Armed Conflict) concerns," according to a Blinken aide's email.

The Law of Armed Conflict, a group of international laws and treaties, prohibits attacks on civilians and requires combatants to minimize civilian death and damage.

While preserving military ties with Riyadh, the Obama administration has tried to reduce civilian casualties by providing the Saudis with "no-strike lists" of targets to avoid, dispatching to Saudi Arabia a U.S. expert on mitigating civilian casualties and pressing for peace talks, the officials said.

"If we’re going to be supporting the coalition, then we have to accept a degree of responsibility for what’s happening in Yemen and exercise it appropriately," a senior administration official said.

One no-strike list, called "The Overlay," was delivered to the Saudis in mid to late 2015. It included water and electrical facilities and infrastructure vital to delivering humanitarian aid, a second senior official said.

The United States and the Sunnis, each for their own reasons, cannot permit Bab el Mandeb to fall into Iranian hands, which would exponentially increase Tehran’s power.

And so, in response to Iran’s moves in the area, the United States moved several naval vessels to the area.

A US Naval destroyer, the USS Mason, was patrolling in the area of the Strait of Bab el Mandeb when it was attacked by two Houthi missiles. According to the Pentagon briefing this was not merely a test or a simple misfire. It was an outright attack against a US ship that fortunately missed.

In response, the US struck three Iranian-operated radar stations in Yemen that were aiding the Houthi. Pentagon spokesman Peter Cook made it very clear that the US strikes against the Houthi were defensive and in response to the near miss on the USS Mason. Cook said: “These limited self-defense strikes were conducted to protect our personnel, our ships, and our freedom of navigation.” He continued, “The United States will respond to any further threat to our ships and commercial traffic, as appropriate.”

Now Iran has dispatched not one but two war ships, the Alvand and the Bushehr, to the region. Tasnim, the semi-official Iranian news agency reported on October 13 that the Iranian naval ships were sent as a check against rising pirate activity in area. Really. The report read: “Iran’s Alvand and Bushehr warships have been dispatched to the Gulf of Aden to protect trade vessels from piracy.”

There was, of course, no mention in the semi-official announcement that the Iranian warships were dispatched a mere two hours after the radar stations were struck by the US cruise missiles.

Wenn die beiden iranischen Schiffe bereits zwei Stunden nach der Zerstörung der drei Radaranlagen im Jemen in Richtung Bab el Mandeb ausgelaufen sein sollen, dann besteht entweder kein direkter Zusammenhang oder bei den Iranern brannte 2 Stunden so riiiiichtig der Baum...

Ich glaube eher, dass die Presse hier einen Zusammenhang herstellt, weil es sich gut verkauft. Die Iranische Marine wird in der Region schlicht wiederholt und routinemäßig Präsenz zeigen und danach auch wieder weiterfahren, angeblich sogar bis Südafrika, falls es die Verhältnisse erlauben.

Aber die Iraner wissen sicher genau, dass im Falle Jemens die USA ihre wertvollsten "Verbündeten" sein können smile.gif Die USA dürften kein Interesse haben, in den Konflikt hineingezogen zu werden und der Iran sollte sich eigentlich bewusst sein, dass er im Jemen diplomatisch gesehen noch am ehesten bei den Amis punkten kann (diese Punkte sind dann wieder gut in Syrien investiert). Da der Iran schon öfters in der Region unterwegs war gehe ich von einer "Standardmission" aus... vieleicht nimmt man medienwirksam nahe der Amis ein paar "Piraten" hops.

Der 81-jährige maronitische Christ ist zwar ein Verbündeter der mächtigen Schiitenmiliz Hisbollah, er erhielt aber auch die Unterstützung des sunnitischen Ex-Ministerpräsidenten Saad Hariri. Diesen dürfte Aoun im Gegenzug nun wieder zum Regierungschef ernennen.

Für den ehemaligen Armeechef Aoun stimmten 83 Abgeordnete, wie Parlamentspräsident Nabih Berri mitteilte. 36 enthielten sich der Stimme, acht Stimmzettel waren ungültig.
Hariri erklärte, seine Unterstützung für Aoun sei notwendig, um "den Libanon zu schützen, das politische System zu schützen, den Staat und das libanesische Volk zu schützen". Überraschend war, dass sich für Aouns Kandidatur auch ein weiterer seiner größten Rivalen, Samir Geagea, aussprach. Dieser ist Chef der christlichen Miliz Libanesische Streitkräfte (FL).

Der Libanon ist seit Jahren politisch gelähmt. Das Parlament ist tief gespalten zwischen einem von den USA und Saudi-Arabien unterstützten Lager um Hariri und einem von der Hisbollah angeführten Block, der vom Iran und Syrien unterstützt wird. Hariri war bereits von 2009 bis 2011 Ministerpräsident.

UNICEF: Malnutrition in Yemen at an all time high

The United Nations International Children’s Emergency Fund (UNICEF) has said that the highest ever recorded rates of malnutrition kids in Yemen comes as Saudi Arabia continues with aggression against the country.

UNICEF said in a report on Monday that nearly 2.2 million children in the impoverished country need immediate care because of acute malnutrition, with 1.7 million alreaady suffering from moderate acute malnutrition.

This is an increased figure of almost 200% from the 2014 recordings.

WASHINGTON — One American commando was killed and three others were wounded in a fierce firefight early Sunday with Qaeda militants in central Yemen, the military said on Sunday. It was the first counterterrorism operation authorized by President Trump since he took office, and the commando was the first United States service member to die in the yearslong shadow war against Al Qaeda’s Yemen affiliate.

Members of the Navy’s SEAL Team 6 carried out the surprise dawn attack, and the military said that about 14 Qaeda fighters were killed during a nearly hourlong battle. A Qaeda leader — a brother-in-law of Anwar al-Awlaki, the American-born cleric and top Qaeda leader in Yemen, who died in a drone strike in 2011 — was believed to have been killed.

After initially denying that there were any civilian casualties, American officials said they were assessing reports that women and children had died in the attack.

The military’s Joint Special Operations Command had been planning the mission for months, according to three senior American officials. Obama administration aides had deliberated extensively over the proposed operation, weighing the value of any information that might be recovered against the risk to the Special Operations forces plunging into hostile territory. But administration officials ultimately opted to hand the decision on the mission to their successors.

Mr. Trump, who has vowed to increase pressure on militant groups worldwide, was quickly persuaded that the rewards were worth the gamble, and he authorized the mission last week, military officials said. Commandos waited for a moonless evening on Saturday to exploit their advantage of fighting at night.

As helicopter gunships and armed Reaper drones provided cover, the commandos carried out the attack against the home of the Qaeda leader in the rugged mountainous region of Bayda Province, a part of Yemen that has been a focal point of United States military operations over the past month. The main target was computer materials inside the house that could contain clues about future terrorist plots.

In a statement on Sunday, Mr. Trump called the raid “successful” and said that it had captured “important intelligence that will assist the U.S. in preventing terrorism against its citizens and people around the world.” He also lamented the loss of the American service member “in our fight against the evil of radical Islamic terrorism.”

The military’s Central Command said in an earlier statement on Sunday that “similar operations have produced intelligence on Al Qaeda logistics, recruiting and financing efforts.” In previous raids in Iraq, Syria and Somalia, commandos have recovered laptop computers, thumb drives and cellphones that yielded important information about militant leaders’ locations, activities and associates.

A United States military aircraft helping with the operation experienced a “hard landing” near the site of the raid, resulting in injuries to two other service members, military officials said. That aircraft, identified by a senior American official as an Osprey that was evacuating the troops wounded in the firefight, was unable to fly after the landing and was deliberately destroyed by American airstrikes. The wounded troops and the Osprey’s crew were lifted to safety by another American aircraft.

American officials and analysts said the Qaeda leader who was believed to have been killed was Abdulrauf al Dhahab.

Servicemember killed in raid on al-Qa’ida headquarters in Yemen

TAMPA, Fla. – One U.S. servicemember died of wounds suffered in a raid against al-Qa’ida in the Arabian Peninsula in Yemen, Jan. 28.

“We are deeply saddened by the loss of one of our elite servicemembers,” said Commander of U.S. Central Command Gen. Joseph Votel. “The sacrifices are very profound in our fight against terrorists who threaten innocent peoples across the globe.”

Three U.S. servicemembers were wounded in the raid.

A U.S. military aircraft assisting in the operation experienced a hard landing at a nearby location, resulting in an additional U.S. injury. That aircraft was unable to fly after the landing. The aircraft was then intentionally destroyed in place.

The operation resulted in an estimated 14 AQAP members being killed and the capture of information that will likely provide insight into the planning of future terror plots.

This is one in a series of aggressive moves against terrorist planners in Yemen and worldwide. Similar operations have produced intelligence on al-Qa’ida logistics, recruiting and financing efforts.

The name of the servicemember killed in action is being withheld pending next of kin notification.

Die Frage stellt sich etwas, ob das eine Antischiffslenkwaffe war oder (was ich eher glaube) eine Aktion mit einem Kamikazeboot. Das Video scheint geschnitten zu sein und ich meine, man sieht ein Boot kurz vor der Detonation.

The known possible civilian casualties appear to have been potentially caught up in aerial gunfire that was called in to assist U.S. forces in contact against a determined enemy that included armed women firing from prepared fighting positions, and U.S. special operations members receiving fire from all sides to include houses and other buildings.

This complex situation included small arms fire, hand grenades and close air support fire. Analysts are carefully assessing whether additional non-combatant civilians that were not visible to the assault force at the time were mixed in with combatants.

The raid resulted in the seizure of materials and information that is yielding valuable intelligence to help partner nations deter and prevent future terror attacks in Yemen and across the world.

“Al-Qa’ida in the Arabian Peninsula has a horrifying history of hiding women and children within militant operating areas and terrorist camps, and continuously shows a callous disregard for innocent lives,” said Col. John J. Thomas, U.S. Central Command spokesman.

“That’s what makes cases like these so especially tragic.”

Möglicherweise, bzw. anscheinend wurde eine Militärbasis in Riyadh von einer ballistischen Rakete getroffen. Die Rakete soll aus dem Jemen abgefeuert worden sein. Bislang berichten allerdings mehrheitlich iranische und jemenitische Nachrichtenagenturen darüber. Die Quellenlage ist daher unübersichtlich bis ungalubwürdig.

Wenn das wirklich so wäre, dann würden die jemenitischen Streitkräfte über Mittelstreckenraketen verfügen, mit einer Reichweite von über 1000 Kilometer. Unmöglich vielleicht nicht, aber eher unwahrscheinlich.

Ja und nein. Ich halte den ganzen Vorfall für dubios bis unbestätigt, wie auch geschrieben. Aber die jemenitischen Streitkräfte verfügen über Eigenproduktionen der Scud-D, die im Grundtyp eine Reichweite von 800 km hat. Je nachdem, wie man "Militärbasis in Riyadh" auslegt - das können auch mal 50-100 km und eine Basis "bei" Riyadh sein, und von wo die Rakete abgeschossen wurde, ist es durchaus im Bereich des möglichen mit einer Scud-D so weit nach Saudi Arabien hinein zu feuern.

Vorausgesetzt, es gab über haupt eine Explosion im Großraum Riyadh, die von einer Rakete stammen könnte. Die überregionalen und vor allem freien Medien berichten immer noch nichts.

Kurzer Nachtrag mit Link zu Wikipedia, die jemenitischen Kräfte haben bereits im Oktober 2016 die King Fahad Air Base bei Taif bombadiert. Das sind allerdings nur 520 km in saudisches Gebiet hinein. Link: https://en.wikipedia.org/wiki/Scud#1994_Yem....80.93Saudi_War

Ich habe das einmal nachgemessen. Der angegriffene Ort soll bei Al Muzahimiyah, rund 40 Kilometer westlich von Riad liegen. Von einem Luftwaffenstützungpunkt, welcher sich in der Hand der Huthi befindet, an der nordjemenitischen Grenze wäre dies eine Distanz von etwas mehr als 800 Kilometer. Das könnte mit der jemenitischen Borkan (Scud-basiert) vielleicht gerade noch erreichbar.

Von Riad Zentrum bis dorthin wo die jemenitische Grenze mal war, sind es gerade mal 700 km. Ist auch nicht so das der Einsatz ballistischer Raketen in diesem Krieg eine Neuerscheinung wäre. Ist auch interessant zu beobachten, wie die Entwicklung bei der Bewaffnung von Schiffen immer wieder auf und ab geht. Verändert sich die politische Situation vergisst man die vorher gemachten Erfahrungen und fokusiert sich nur auf die veränderte Lage, als gäbe es nichts anderes. Dann ändert sich die Lage wieder und man steht ohne Schutz da und man fängt wieder an alte Weisheiten zu beachten... smile.gif

Was heißt hier "man vergisst"? Man kann eben nicht alles gleichzeitig an Bord installieren oder ein Schiff für absolut wirklich jeden Fall bauen. wink.gif

Und das Wissen geht nicht "verloren", man speichert es für gewöhnlich im kulturellen Gedächtnis, also vorwiegend schriftlich ab, damit im kommunikativen Gedächtnis einer Berufsgruppe Platz ist für neue Diskurse. Aber es bleibt im kollektiven Gedächtnis natürlich trotzdem vorhanden. Man muss es nur wieder aktivieren.

Die Huthi haben sich jetzt zu dem Raketenangriff nahe Riad bekannt und vor allem erklärt, das aufgrund "technischer Fortschritte" die saudische Hauptstadt nun in Reichweite liegt. "Größeres" soll bald folgen... Das ist wohl als Aufforderung gemeint, zweimal darüber nachzudenken, die nächste Trauerfeier zu bombardieren.

Im Jemen tobt ein erbitterter Bürgerkrieg zwischen Anhängern der vom Iran unterstützten schiitischen Huthi-Rebellen und Gruppen, die der international anerkannten Regierung nahestehen. Aden ist die provisorische Hauptstadt des verarmten arabischen Landes, die eigentliche Hauptstadt Sanaa und große Landesteile stehen unter Kontrolle der Rebellen befinden. Eine von Saudi-Arabien geführte Militärallianz bekämpft die Rebellen. Ihr Ziel ist es den Einfluss des Iran in der Region zurückzudrängen.

Im Konflikt zwischen Sunniten und Schiiten schaut die Welt auf Syrien. Derweil spielt sich im Jemen eine ähnlich dramatische Tragödie ab. Die Vereinten Nationen warnen vor einer Hungerkatastrophe, das US-Militär intensiviert seine Angriffe auf Al-Qaida-Stellungen im Land.

Die Truppen der international anerkannten Regierung von Abd Rabbo Mansour Hadi kämpfen erbittert gegen die Rebellen. Seit März 2015 werden sie dabei von Saudi-Arabien unterstützt, vor allem mit Angriffen aus der Luft.

Anfang Februar wird die Saudi-arabische Fregatte "Al-Medina" im Hafen von Jeddah empfangen. Kurz zuvor war sie an der jemenitischen Westküste von Huthi-Rebellen angegriffen worden.

"Mit unserer Militäroperation beweisen wir der Welt, dass Saudi-Arabien für Stabilität im Jemen sorgt", sagt General al-Bunyan, der Stabschef der Armee des Königreiches beim Empfang der Fregatte. Die Militäroperation heißt "Sturm der Entscheidung". Das sunnitische Saudi-Arabien sieht in den Huthi-Rebellen einen verlängerten Arm des schitischen Erzfeindes Iran.

Die jemenitische Huthi-Volksgruppe gehört zu den Zaiditen – also zu einer Sonderform unter den Schiiten, die den Sunniten im Jemen mindestens ebenso nahesteht wie den Schiiten im Iran. Die Huthis hatten sich anfangs auch vor allem gegen die Diskriminierung im eigenen Land erhoben. Der Konflikt hat innerjemenitische Wurzeln. Aber der konfessionelle Blick auf den Konflikt, besonders in Saudi-Arabien, hat aus dem Bürgerkrieg einen regionalen Stellvertreterkrieg gemacht.

Die saudischen Kampfjets beschießen nicht nur die Aufständischen, sondern auch Märkte, Krankenhäuser und Hochzeitsgesellschaften. Die Aufständischen kämpfen mit Panzern und Artillerie. In den vergangenen zweieinhalb Jahren sollen mehr als 10.000 Menschen ums Leben gekommen sein.
Laut UN 3,3 Millionen Menschen vom Hungertod bedroht
"Unsere Leben sind zerstört", klagt dieser Mann aus der Hauptstadt Sanaa. "Wir hausen unter einer Plane, ohne Küche oder Toilette. Wir haben nicht mal Decken für die Kinder. Die Lebensmittel, die wir erhalten, reichen gerade so, um nicht zu verhungern."

Inzwischen sollen sieben von zehn Jemeniten auf Nothilfe aus dem Ausland angewiesen sein. Das wären knapp 20 Millionen Menschen. Aber diese Nothilfe, sagt William Spindler vom Flüchtlingshilfswerk der Vereinten Nationen, könne nur sehr schwer ins Land gebracht werden, weil Häfen umkämpft und Flughäfen außer Betrieb seien. UN-Angaben zufolge sind 3,3 Millionen Menschen akut unterernährt und vom Hungertod bedroht, vor allem Kinder.

Solch große Menschenansammlungen hat man in den USA das letzte Mal im Jahr 2009 bei der Vereidigung von Präsident Obama gesehen.
Und was das Perfide an der Sachde ist: Da protestieren 100.000 Menschen in einem Kriegsland friedlich für ein Ende der Luftangriffe welche ein bereits armes Land ins infrastrukturelle Vakuum zerlegen und die Welt schaut einfach weg... mata.gif
